Terms of Service — Crestiq Ltd

1. Introduction

These Terms of Service govern your use of crestiq.uk and any purchases made through it. By accessing our website or placing an order, you confirm that you have read, understood, and agreed to these Terms in full.

If you do not agree with any part of these Terms, you must not use our website or place an order.

Crestiq Ltd reserves the right to update these Terms at any time. The version published on this page at the time of your order will apply to that order.

2. About Us

Crestiq Ltd is a handmade crochet business based in the United Kingdom. Every item we sell is handmade by hand — this means minor natural variations in colour, size, and finish are an inherent characteristic of handmade goods and do not constitute a fault or misrepresentation.

Product photographs are as accurate as possible, but slight colour variations may occur due to screen display settings. This is not grounds for a return or refund.

3. Eligibility

By placing an order, you confirm that:

You are at least 18 years of age
You are purchasing as a consumer for personal use only — not for resale or commercial purposes
All personal information provided is accurate, complete, and up to date
You are legally entitled to use the payment method provided

4. Orders & Contract Formation

When is a contract formed?
No contract exists between you and Crestiq Ltd until we send you a formal order confirmation email. Placing an order constitutes an offer only — Crestiq Ltd reserves the right to decline any order at our sole discretion without liability.

Pricing errors
In the event that a product is listed at an incorrect price due to a typographical or system error, Crestiq Ltd is not obliged to fulfil the order at that price. We will notify you and offer a cancellation and full refund.

Stock
All orders are subject to availability. If an item becomes unavailable after your order is placed, we will contact you and issue a full refund. Crestiq Ltd accepts no further liability in such circumstances.

Order amendments
Once an order is placed and confirmed, amendments cannot be guaranteed. Please contact us immediately at crestiq.uk/pages/contact if you need to make a change. We will try to help but cannot promise changes can be accommodated once production has begun.

5. Custom & Personalised Orders

All custom and personalised orders are made specifically to your requirements and are strictly non-refundable and non-cancellable once production has begun
It is your sole responsibility to ensure all details — including colour, size, wording, and specifications — are correct before submitting a custom order
Crestiq Ltd will not be held responsible for errors in custom orders resulting from incorrect information provided by the customer
Custom orders may take longer than standard orders — estimated timeframes will be provided but are not guaranteed
The only exception to the non-refundable rule is if the item arrives damaged or materially faulty through our fault

6. Payments

All prices are shown in British Pounds (GBP)
Payment is taken in full at the point of ordering
Crestiq Ltd accepts: Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, Shop Pay, and Klarna
Klarna's Buy Now Pay Later service is subject to Klarna's own separate terms and conditions — Crestiq Ltd accepts no responsibility for any issues arising from your use of Klarna
Crestiq Ltd does not store, see, or have access to your full payment card details at any time
In the event of a fraudulent or disputed payment, Crestiq Ltd reserves the right to cancel the order and pursue recovery through appropriate legal channels

7. Delivery

All items are handmade and require a production period of 3–7 business days before dispatch. Custom orders may take longer
Stated delivery timeframes begin from the date of dispatch, not the date of order
Once dispatched, standard UK delivery typically takes 2–5 business days
Delivery charges are shown at checkout and are non-refundable once an order has been dispatched
Crestiq Ltd is not responsible for delays, losses, or damages caused by Royal Mail, courier services, or any circumstances beyond our reasonable control including but not limited to postal strikes, extreme weather, or customs delays
It is your responsibility to provide a complete and accurate delivery address. Crestiq Ltd accepts no liability for orders lost or delayed due to an incorrect address provided by the customer
If a parcel is returned to us due to an incorrect address or failed delivery attempts, re-delivery charges will apply
International customers are solely responsible for any import duties, customs fees, or taxes applicable in their country

8. Cancellations

Standard orders may be cancelled within 24 hours of placing the order, provided production has not yet begun
After 24 hours, cancellations cannot be guaranteed and are at Crestiq Ltd's sole discretion
Custom and personalised orders cannot be cancelled once production has begun under any circumstances
Under the Consumer Contracts Regulations 2013, consumers have a statutory right to cancel most online orders within 14 days of receipt. However, this right does not apply to custom or personalised items made to your specification, as permitted under Regulation 28(1)(b)

9. Returns & Refunds

Crestiq Ltd does not accept returns or exchanges due to a change of mind, as all items are made to order
We do not accept returns on items that have been used, washed, or damaged after receipt
If your item arrives damaged, faulty, or materially different from its description, you must notify us within 48 hours of delivery via crestiq.uk/pages/contact, providing your order number and clear photographic evidence
Claims made after 48 hours of delivery may not be accepted
Where a valid claim is accepted, Crestiq Ltd will offer a replacement or refund at our discretion
Refunds, where approved, will be processed within 5–7 business days to the original payment method
Crestiq Ltd reserves the right to refuse a refund where we reasonably believe a claim is fraudulent or does not meet the criteria above
Your statutory rights under the Consumer Rights Act 2015 are not affected by this policy

10. Chargebacks & Disputes

If you raise a chargeback or payment dispute without first contacting Crestiq Ltd to attempt resolution, we reserve the right to:

Provide all order evidence, communications, and tracking information to the payment provider
Dispute the chargeback on the grounds that the order was fulfilled in accordance with these Terms
Decline future orders from the customer

11. Intellectual Property

All content on crestiq.uk — including but not limited to photographs, product descriptions, designs, the Crestiq name, logo, and all branding — is the exclusive intellectual property of Crestiq Ltd and is protected under UK copyright law.

You may not reproduce, copy, redistribute, scrape, or use any content from our website for any commercial or non-commercial purpose without prior written consent from Crestiq Ltd. Unauthorised use may result in legal action.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

Crestiq Ltd's total liability for any claim arising from an order shall not exceed the total value paid for that specific order
Crestiq Ltd shall not be liable for any indirect, consequential, special, or economic losses including but not limited to loss of profit, loss of data, or loss of opportunity
Crestiq Ltd is not liable for any loss or damage arising from your use of, or inability to use, our website
Crestiq Ltd is not responsible for the content or practices of any third-party websites linked from our site

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under English law.

13. Website Use

By using crestiq.uk you agree not to:

Use the website for any unlawful or fraudulent purpose
Attempt to gain unauthorised access to our systems or data
Submit false, misleading, or fraudulent orders or reviews
Copy, reproduce, or distribute any content from our website without permission
Use our website in any way that could damage, disrupt, or impair its functionality

Crestiq Ltd reserves the right to suspend or terminate access to the website for any user who breaches these conditions, without notice and without liability.

14. Reviews & Communications

By submitting a review or contacting us, you grant Crestiq Ltd the right to use your words and feedback for marketing and promotional purposes (e.g. sharing a positive review on social media), without further consent or compensation.

You must not submit reviews or communications that are false, defamatory, offensive, or misleading. Crestiq Ltd reserves the right to remove or report any such content.

15. Privacy

Your use of crestiq.uk is subject to our Privacy Policy, which forms part of these Terms of Service. By using our website, you also agree to our Privacy Policy.

16. Governing Law & Jurisdiction

These Terms of Service are governed exclusively by the laws of England and Wales. Any disputes arising from these Terms or from any order placed on crestiq.uk shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint, please contact us first at crestiq.uk/pages/contact. We will make every reasonable effort to resolve disputes directly and fairly before any formal proceedings are initiated.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, Refund & Returns Policy, and Shipping Policy, constitute the entire agreement between you and Crestiq Ltd in relation to your use of our website and any purchases made through it.
